In Russia – a new scandal involving the detention and expulsion from the country famous video blogger Elvin Isayev. The court ruled that the Russian passports obtained by Isaev in 2001 and in 2014 were not valid.
Elvin Isaev was detained on August 24 to verify documents and taken to the 78th police department of St. Petersburg on Chekhov St., 15. By evening, Elvin Isaev was informed that his Russian passport was declared invalid.
According to Elvin Isaev’s lawyer, Magomed Hasanov, the detention of the blogger may be related to his public activities. Isaev has his own YouTube channel. The videos of the blogger sometimes gained more than 40 thousand views, he has 15.5 thousand subscribers. The main topic of the blogger’s speeches is criticism of the Azerbaijani authorities. According to the lawyer E. Isaev, his client was charged under Article 18.8 (Violation by a foreign citizen or stateless person of the rules of entry into the Russian Federation or of the regime of stay (residence) in the Russian Federation) of the Code of Administrative Offenses. The Dzerzhinsky District Court of St. Petersburg decided to find Isaev Elvin born in 1980 guilty of an administrative offense and impose an administrative penalty in the form of a fine of 5 thousand rubles. and expel outside the Russian Federation.
There are many inconsistencies in this story. The 39-year-old Elvin Isaev arrived in Russia at the age of 13 and, upon reaching the age of majority, received a Russian passport, becoming a citizen of Russia, his representative Ragim Mammadov claims. Isaev’s wife, Svetlana, provided “NI” copies of her husband’s Russian passports, as well as a marriage certificate and the birth certificate of two sons born in marriage with Elvin Isaev. In all documents, Elvin Isaev is listed as a citizen of Russia. “In 2014, my husband really changed his passport due to the fact that the previous document became unusable. His passport was replaced. A new document was issued in North Ossetia, ”says the wife of blogger Svetlana. – “All these years, my husband lived in Russia according to Russian passports, using them he made out an apartment purchase, received a driver’s license, issued a passport several times, took loans. No one had any questions for him. ”
From a legal point of view, the situation is ambiguous. On the one hand, in accordance with Part 1 of Article 61 of the Constitution of the Russian Federation, a Russian citizen cannot be expelled from the Russian Federation or extradited to another state. At the same time, the Russian Constitution reads: “Foreign citizens and stateless persons who have committed a crime outside the borders of the Russian Federation and are located on the territory of the Russian Federation may be extradited to a foreign state to prosecute or serve their sentences in accordance with the international treaty of the Russian Federation Federation “
Extradition, according to the Russian Constitution, is an act of legal assistance that is carried out in accordance with the provisions of special international treaties and Russian legislation. Upon extradition, a foreign state shall be extradited to a person who is accused of committing a crime against the interests of that state.
Strictly speaking, claims to Elvin Isaev could arise. The blogger is known for his harsh, negative and sometimes disrespectful remarks on YouTube addressed to statesmen and deputies of the Milli Majlis of Azerbaijan. Also, the 39-year-old native of Azerbaijan previously passed as a suspect in a criminal case, which was later dismissed. This became known from court materials provided to the lawyer E. Isaev.
It follows from the court ruling that the Azerbaijani is not a citizen of the Russian Federation, and the passports received by him twice (in 2001 and 2014) were declared invalid. “E. Isaev did not apply to the competent authorities located in Russia and the diplomatic missions of this country outside the state with the application for Russian citizenship in the prescribed manner. The court was provided with a certificate issued by the Consulate General of the Republic of Azerbaijan in St. Petersburg, according to which “E. Isaev is a citizen of Azerbaijan. Based on the foregoing, the court concludes that a citizen of Azerbaijan E. Isaev grossly violated the regime of stay of foreign citizens on the territory of the Russian Federation,” the resolution says research institute.
In her address to the President of Russia, her husband Elvin Isaev stated: “How could a person live for 18 years in Russia according to a Russian passport if he was invalid? Why didn’t anyone pay attention to this before? Over the past three years, my husband was a blogger, and in the last year he criticized the Azerbaijani government. But in Russia, freedom of speech, this was the basis of my husband. Recently, he received threats of life. Elvin was threatened: “If you don’t shut your mouth, they can take your life,” said the wife of the blogger.
“NI” turned to the Union of Russian Journalists with a request to comment on the fact of the expulsion from Russia and deprivation of Russian citizenship of a video blogger known for his opposition views. “In the event of a problem, especially a threat to a journalist, our legal service, the secretariat of the SJR is always ready to take part in the fate of a journalist. As for the case of Mr. Isaev, no messages were sent to us. We understand that the situation is quite confusing. If Isaev, his lawyer, his family consider that not only civil, but also his professional rights are violated, we are ready to consider any appeal and take part in it, ”said Timur Shafir, Secretary of the Union of Journalists of Russia.
